Abstract
Nuestro Trabajo de Titulación tiene como objetivo general, exponer la pluralidad de
valoraciones emitidas por Jueces de Garantías Penales, al imponer sanciones en delito
de Tráfico de Sustancias Psicotrópicas y Estupefacientes; entre los objetivos específicos
en nuestro trabajo son analizar la diversidad de criterios expuestos dentro de sentencias
por Tráfico de Sustancias Psicotrópicas y Estupefacientes dentro del COIP, contenidos en
las causas n° 07711-2016-00194 y n° 01658-2016-00269; contrastar los procedimientos
en que fueron sustanciadas las causas n° 07711-2016-00194 y n° 01658-2016-00269;
sugerir un método que permitan determinar uniformidad de criterios en los Jueces de
Garantías Penales, dentro de nuestra Normativa Penal, al momento de establecer la Pena,
en los delitos de Tráfico de Sustancias Psicotrópicas y Estupefacientes; y, determinar la
facultad que tienen Jueces de Garantías Penales, al momento de establecer la
proporcionalidad de las penas en el delito de Tráfico de Sustancias Psicotrópicas y
Estupefacientes, al aceptar el Procedimiento Abreviado.
Description
Our Work Titling general objective, exposing the plurality of ratings issued by Judges of
Criminal Guarantees by imposing penalties on offense trafficking in psychotropic and
narcotic substances; Among the specific objectives of our work we are to analyze the
range of opinions expressed in sentences for trafficking Narcotics and Psychotropic
Substances within the COIP contained in cases No. 07711-2016-00194 and n ° 01658-
2016-00269; contrast the procedures that were substantiated causes No 07711-2016-
00194 and n ° 01658-2016-00269; suggest a method for determining uniformity of criteria
in the Criminal Guarantee Judges within our criminal law, when setting the penalty, in the
crimes of trafficking in psychotropic and narcotic substances; and determine the power of
Criminal Guarantees have judges, when establishing the proportionality of the penalties for
the crime of Trafficking in Narcotic Drugs and Psychotropic Substances, accepting the
Expedited Procedure. Conducting a dogmatic analysis of the procedural principles in our
country, the approval process of the factual and legal merit, on the arrest in flagrante
delicto, structural elements of the offense and the abbreviated procedure. The
methodology used was descriptive, worked with the inductive-deductive, descriptive
methods, analysis-synthesis, etc. In addition, our specialists work demanded participation
in the legal areas especially in criminal law, including lawyers in free practice and officials
working in areas related to our research. Reaching results that support the verification of
the objectives set at the outset of the investigation, it ie that there are many criteria on
which it bases its reasoning expressed in judgment.
