Abstract
COVID-19 is a disease with high rates of spread and mortality that has led to the worldwide establishment by governments of measures that limit the exercise of fundamental rights, especially the right to autonomous work in public spaces. Such is the case of GAD Machala that as a mechanism to guarantee the right to health in the face of the Covid-19 pandemic, it promulgated a municipal ordinance that restricts the right to face it, the concern arises to analyze whether the administrative decisions of the institution should focus solely on guaranteeing the right to health? How should the municipal administration of Machala deal with the consequences of the COVID-19 pandemic on the right to work?

El COVID-19 es una enfermedad con altas tasas de propagación y mortalidad que ha propiciado a nivel mundial el establecimiento por parte de los gobiernos de medidas que limitan el ejercicio de los derechos fundamentales en especial el derecho al trabajo autónomo en espacios públicos. Tal es el caso del GAD Machala que como mecanismo para garantizar el derecho a la salud ante la pandemia del Covid-19 promulgó una ordenanza municipal que restringe el derecho frente a ello surge la inquietud de analizar si ¿las decisiones administrativas de la institución deben centrarse únicamente en garantizar el derecho a la salud?, ¿cómo debería la administración municipal de Machala tratar las consecuencias de la pandemia de COVID-19 sobre el derecho al trabajo?
