In the present investigation has deepened much in the concept, rationale and scope of the legal guarantee of habeas corpus, as well as the requirements for admission, is requires a custodial determination illegal, illegitimate or arbitrary manner that should be corrected in the constitutional jurisdiction over this warranty.es_ES
dc.description.abstractEl objetivo general del presente trabajo de titulación buscó determinar si en la sustanciación del proceso de acción de habeas corpus 07317-2012-0424 que estuvo a cargo del Juez Décimo Séptimo de lo Civil de El Oro, existió pleno reconocimiento de la independencia de la jurisdicción penal y de la decisión del juez Noveno de lo Penal de El Oro que ordenó la prisión preventiva de FULTON JAEN SANTANDER Y Otros en audiencia de calificación de flagrancia por el delito de Rebeldía 07259-2012-0078. En la presente investigación se ha profundizado mucho en el concepto, fundamento y alcance de la garantía jurisdiccional de habeas corpus, es decir la determinación precisa de una privación de la libertad de manera ilegal, ilegítima o arbitraria que debe ser corregida en la jurisdicción constitucional a través de esta garantía.es_ES
