Abstract
El objetivo general del presente trabajo de titulación buscó determinar si en la sustanciación del proceso de acción de habeas corpus 07317-2012-0424 que estuvo a cargo del Juez Décimo Séptimo de lo Civil de El Oro, existió pleno reconocimiento de la independencia de la jurisdicción penal y de la decisión del juez Noveno de lo Penal de El Oro que ordenó la prisión preventiva de FULTON JAEN SANTANDER Y Otros en audiencia de calificación de flagrancia por el delito de Rebeldía 07259-2012-0078. En la presente investigación se ha profundizado mucho en el concepto, fundamento y alcance de la garantía jurisdiccional de habeas corpus, es decir la determinación precisa de una privación de la libertad de manera ilegal, ilegítima o arbitraria que debe ser corregida en la jurisdicción constitucional a través de esta garantía.

The overall objective of this study sought to determine whether titling in the substantiation process 07317-2012-0424 protective action that was conducted by Judge Seventeenth Civil of El Oro, there was full recognition of the independence of the criminal jurisdiction and the decision of the Ninth Criminal Judge of El Oro who ordered the detention of JAEN FULTON SANTANDER and others in audience rating of flagrante delicto for the crime of Rebellion 07259-2012-0078. In the present investigation has deepened much in the concept, rationale and scope of the legal guarantee of habeas corpus, as well as the requirements for admission, is requires a custodial determination illegal, illegitimate or arbitrary manner that should be corrected in the constitutional jurisdiction over this warranty.
