Abstract
La mediación es un método alternativo extrajudicial de resolución de conflictos independientemente de la naturaleza del mismo, la ventaja de éste proceso es que el acuerdo lo plantean las mismas partes involucradas y por ende lograra satisfacción ante las exigencias de las dos partes, el proceso se realiza con la ayuda de un tercero llamado mediador quien mantiene una posición neutra ante la eventualidad. Se presentará a continuación, la mediación paso a paso de un conflicto entre dos empresas generado por las actividades comerciales que mantienen entre si, las cuales deciden someterse al proceso de mediación de manera voluntaria buscando solucionar la controversia en la que se encuentran. Se describirá de manera secuencial los pasos de la deliberación hasta llegar a un acuerdo de tipo gana – gana.
Description
The mediation is an extrajudicial alternative method of resolution of conflicts independently of the nature of the same one, the advantage of this one process is that the same involved parts raise the agreement and hence it will achieve satisfaction before the requirements of two parts, the process realizes with the help of a third one called madiador who maintains a neutral position before the contingency.The mediation will appear next, step by step of a conflict between two companies generated by the commercial activities that they maintain if, which decide to submit to the process of mediaciónde voluntary way thinking about how to solve the controversy in which they are. The steps of the deliberation will be described in a sequential way up to coming to a type agreement it wins – wins.
