dc.descriptionEl Ecuador ha establecido garantías jurisdiccionales para la protección de los derechos principalmente ante el abuso en las actuaciones públicas. Entre ellas se encuentra la acción de protección que ha sido ampliamente difundida desde el 2008, sucediendo con éxito al antiguo recurso de amparo. Sin embargo, existe el peligro que se desnaturalice el ámbito de aplicación de esta garantía y que se abuse de esta acción. En este caso en particular, se analizará cuáles son los límites que tiene el Estado para presentar como parte actora la acción de protección.es_ES
dc.description.abstractEcuador has established jurisdictional guarantees for the protection of rights, mainly against public actions. One of them is the Protection Action that has been spread successfully since 2008, succeeding the old protection appeal. However, there is a riskthat the area of application of this guarantee can be denature resulting in the abuse of this action. In this particular case, the limits of the State to file as plaintiff the protectionaction will be analyzed.es_ES
