El influjo psíquico como instrumento directo para la autoría mediata

Abstract

Mediated authorship and participation in punishable behavior are technical studies that define contributions based on the social division of labor in crime, so that in today's Ecuador the problem occurs in the specific expression in the participation rules. Analyzing the COIP of Ecuador Art. 42 literal 2 establishes that those who suggest or instigate actions will be responsible as authors of the mediation, thus violating the principle of collateral crime. In this simple but heartfelt investigation, the technical and scientific concepts involved in the instigator or inducer as attachment will be clarified and used as a basis. The principle of criminal and harm is based on what is typical, illegal and the guilty act or subject of the author is based on the principles and guarantees guaranteed by the criminal law of conduct and the Constitution of the Republic of Ecuador. Psychic influence is one of the most used forms in relation to mediate authorship, that is why in this work its direct relationship is analyzed in order to avoid omissions about these delinquent acts in cases where unjust sentences are given, to people who didn't deserve it.
