Abstract
El objetivo general del trabajo es principalmente justificar el legitimado pasivo respecto a una relación laboral entre un chofer de taxi y el propietario del vehículo y respecto también a la Compañía de taxis, la metodología empleada ha sido aplicar la hermenéutica constitucional, así como también la interpretación de textos legales y jurisprudenciales, teniendo como resultados principales el análisis de las principales concepciones objetivas y subjetivas del derecho laboral. Lograremos concluir justificando el legitimado pasivo, es decir quién es el legítimo contradictor en este tipo de conflictos, que medios de prueba presentaría sobre este hecho dirimente en el proceso laboral por haberes e indemnizaciones que de seguro es lo fundamental para el protagonista de esta acción.
Description
The overall objective of the work is mainly passive legitimized justify regarding an employment relationship between a taxi driver and the owner of the vehicle and also regarding the taxi company, the methodology has been applied constitutional hermeneutics, as well as the interpretation of legal texts and jurisprudence, with the main results of the main analysis objective and subjective conceptions of labor law. We achieve end justifying the passive legitimacy, ie who is the rightful gainsaying in this type of conflict, that evidence presented on this casting made in the work process for salaries and compensation insurance is fundamental to the protagonist of this action.
