| dc.description | El presente trabajo de investigación se ha desarrollado con el objetivo principal de evidenciar si es necesario que la legislación penal ecuatoriana instituya el recurso de nulidad. En el desarrollo del trabajo se ha hecho una revisión de la manera en que los juzgadores han venido aplicando su potestad de declarar nulo el proceso en los casos en que hayan existido afectaciones al derecho a la defensa, y si el ejercicio de esa potestad se ha realizado de manera oportuna. La nulidad actualmente no existe como recurso en el proceso penal desarrollado en el Código Orgánico General de procesos, pero el mismo cuerpo normativo además de la Constitución de la República han revestido al juzgado de la potestad de subsanar los vicios del proceso o declarar nulidad en cualquier estado o etapa del mismo, pero el hecho de que no exista un recurso independiente hemos concluido que ha venido afectando derechos de los procesados, sobre todo cuando se ha impuesto en su contra la medida cautelar personal de prisión preventiva. La inexistencia del recurso de nulidad, impide que el procesado al evidenciar una violación al debido proceso, el derecho a la defensa o cualquiera de sus garantías, no la pueda exigir en ese mismo momento, sino que debe esperar el desarrollo de las diferentes etapas del proceso para poderse pronunciar. | es_ES |
| dc.description.abstract | The present research work has been developed with the main objective of evidencing whether it is necessary for the Ecuadorian criminal legislation to institute the appeal for annulment.
