Abstract
El presente Trabajo de Titulación, como objetivo principal es determinar si existió una
correcta aplicación del derecho al momento del juzgador emitir sentencia, determinar si
por el delito que se llevó efecto la causa penal Nro. 0027-2015, reunió los elementos del
delito, esto es si se cumplieron con los presupuestos de la Tipicidad Objetiva y Subjetiva,
a fin de sancionar a la ciudadana Diana Cortez Uyuncare por el delito de asociación
ilícita, sancionado por el Estado Ecuatoriano. Investigamos si el procedimiento directo
por el cual se tramitó el proceso penal de asociación ilícita fue el más apropiado para
poder determinar su culpabilidad, dado la naturaleza del tipo penal de asociación ilícita
que necesita de una ardua investigación.
Description
The current titulation work, as a main objective is to determine if it was a correct
application of the right at moment when judger emits judgement, to determine if the guilt
was effected with the penal case No. 0027-2015, put together all elements of guilt, it is if
the budgets were executed of the objective and subjective type, ending to sanction to
townswoman Diana Cortez Uyuncare for illicit association guilt, sanctioned by Ecuadorian
State.
We research if the direct processing because the penal process illicit association was the
most appropriated to can determine its culpability, according the penal type of illicit
association which needs of a hard researching.
