Abstract

In the present work, the figure of the control of conventionality in the public administration and its application for the protection of human rights will be addressed, since with this the action of the States Parties and their internal regulations with the American Convention and other precautions are taken. International human rights instruments. The origin of the control of conventionality in the jurisprudence of the Inter-American Court of Human Rights will be developed, the foundation will be established in the Ecuadorian legal system and its mandatory application in the Public Administration will be determined, taking into consideration the constitutional ruling on same-sex marriage. Where the jurisprudential precedent is established in which all public authorities must exercise control of conventionality in the exercise of their powers and functions at the time of adopting their decisions, for which a documentary analysis will be carried out with a legal approach of a descriptive and explanatory nature.
