Garantías aplicables a los procesos por la contratación de obras de infraestructura en las instituciones públicas.

Abstract

The main objective of this paper is to investigate which are the guarantees applicable to the processes by contracting infrastructure works in public institutions through the bibliographic review of the legal basis for a better knowledge of the regulations applicable to the public sector. The methodology used to carry out this research is qualitative of a hermeneutic nature due to the fact that an analysis of the relevant documentation is carried out on guarantees and advances that arise within said process, such as the review of the legal part, previous investigations of articles scientists and books that mention the topic to be treated. The result obtained was given according to the legal basis of Ecuador within the Organic Law of the National System of Public Procurement, in which it is established that the guarantees can be faithfully fulfilled or guarantees in advance, thus answering the question of the case practical.
