Abstract
En el presente trabajo de investigación se desarrolla de conformidad con los presupuestos establecidos por el sistema de titulación de la Universidad Técnica de Machala previo a la Obtención del Título de Abogado de la Juzgados y Tribunales de la República del Ecuador, cuyo tema de investigación es la Importancia del interés superior del niño y su eficacia ante los órganos jurisdiccionales; trabajo que presenta el análisis de la carencia de legislación en tenencia compartida en el Código de Niñez y Adolescencia ecuatoriana, la custodia compartida es la situación legal mediante la cual, en caso de separación matrimonial o divorcio, los dos progenitores ejercen la custodia legal de sus hijos menores de edad, en igualdad de condiciones y derechos.
Description
In this research work is developed in accordance with the budgets established by the titling system of the Technical University of Machala prior to Obtaining the Degree of Lawyer of the Courts and Tribunals of the Republic of Ecuador, whose research topic is the Importance of the best interests of the child and their effectiveness before the jurisdictional organs; work that presents the analysis of the lack of legislation on shared tenancy in the Ecuadorian Code of Children and Adolescents, joint custody is the legal situation whereby, in case of marital separation or divorce, the two parents exercise legal custody of us underage children, under equal conditions and rights.
