La responsabilidad penal por daño ambiental a causa de la mineria ilegal en el cantón Santa Rosa

Abstract

All research related to environmental rights issues are always inclined to be of great social interest, since actions that violate rights are increasingly exposed to causing irreversible damage to the environment. In a particular way, this scientific article will focus on analyzing criminal responsibility in the Ecuadorian legal system against those who harm the environment through illegal mining, with the main focus on the Santa Rosa canton, El Oro Province. For this reason, it is important to investigate based on the doctrine and the law as illegal mining attentive to the rights of nature in Ecuador, although the rights of nature have appeared several decades ago, as of 2008 it was it is conceived as a subject of rights and the importance it deserves to this central issue is just being passed on; This work was developed through a qualitative, non-experimental, descriptive, analytical, hermeneutical methodology and with the research techniques of observation and reading. Concluding, that the rights of nature have been violated through illegal mining, since in Ecuador and especially in the Santa Rosa canton, mining is not constantly regulated and supervised based on current regulations, for This affects the nearby towns that live in the areas where the activity takes place without any type of control.
