Abstract

The legal problem that is the subject of this case study focuses on the legal analysis and evaluation of the administrative acts in its form, issued by the Municipal Decentralized Autonomous Government of Machala Canton, this around the relationship that the Public Administration has with the citizenship. Since there is no way to evaluate the application of the theory of the administrative act in the Municipal Government of Machala, according to what is established in the Administrative Organic Code, we have seen the need to apply a structural follow-up to this Administration during the period 2023-2024, since it is a way to determine the effectiveness and efficiency of the authorities in the fulfillment and development of their functions. Therefore, through this research, a mixed approach has been proposed, on the one hand, qualitative based on interviews with certain authorities of the different directorates, and on the other hand, quantitative through a rubric that evaluates whether or not the average administrative acts comply with the validity requirements established in Article 99 of the COA. While it is true that the administrative authorities have the power to issue acts as a result of their will and competence, it is also true that there must be a regulation of those, in order to safeguard the good public organization, the satisfaction of the needs of citizens and the protection of internal order.
