dc.descriptionEl objetivo del presente artículo es realizar un análisis del reto que se presenta ante la legislación educativa de regular el proceso educacional de manera que se respeten en él los derechos educativos y se convierta en el que necesita la sociedad para la formación integral de la personalidad de las jóvenes generaciones. Para ello se realizó una investigación documental acerca de aspectos vinculados a la legislación educativa que han sido abordados por varios autores y se recogen en diferentes instrumentos jurídicos. Entre los principales hallazgos se destaca que la formación de la personalidad de los estudiantes dentro de un marco de respeto a los derechos y libertades fundamentales es el principal objetivo en la legislación educativa y que esta se proyecta hacia tres direcciones: el mejoramiento de la calidad, el derecho al acceso y la equidad. Dentro de sus conclusiones principales se plantea que la legislación educativa se convierte en una herramienta auxiliar para la educación por formular aquellos preceptos que determinan la regulación de las prácticas educativas impulsándolas hacia su mejoramiento.es_ES
dc.description.abstractThe objective of this article is to perform an analysis of the challenge that is presented before the educational legislation to regulate the educational process so that it respects the educational rights and becomes the one that society needs to develop the integral formation of the personality of the young generations. For this, a documentary investigation was carried out on aspects related to educational legislation that have been addressed by several authors and are included in different legal instruments. Among the main findings, it is highlighted that the formation of the personality of the students within a framework of respect for fundamental rights and freedoms is the main objective in the educational legislation and that this is projected in three directions: the improvement of quality, the right to access and equity. Among its main conclusions, it is stated that educational legislation becomes an auxiliary tool for education by formulating those precepts that determine the regulation of educational practices, promoting them towards their improvement.es_ES
