| dc.description | El ordenamiento jurídico ecuatoriano, desde su Constitución, reconoce la inviolabilidad de la vida (art. 66.1) y como parte de la entrada en vigencia del COIP, en el año 2014, dentro de la regulación penal se inserta el tipo penal de femicidio. Esta inserción no está exenta de debate, y desde algunos sectores de la doctrina se cuestiona si ésta responde a estudios de política criminal así como la verdadera incidencia preventiva y sancionatoria de este tipo penal. El objetivo del presente trabajo es analizar en primer lugar, el tipo penal de femicidio, con énfasis en la regulación ecuatoriana, y en segundo lugar, la incidencia de la tipificación de este delito en el cantón Machala, Ecuador, en el período 2019-2020, utilizando los métodos analítico, sintético, exegético y comparativo. Se llega a la conclusión que la inclusión y aplicación de este tipo penal en el COIP no ha traído consigo una baja en la comisión de este delito, por el contrario, los niveles han aumentado. | es_ES |
| dc.description.abstract | The Ecuadorian legal system, from its Constitution, recognizes the inviolability of life (art. 66.1) and as part of the entry into force of the COIP, in 2014, within the criminal regulation the criminal type of femicide is inserted. This insertion is not exempt from debate, and some sectors of the doctrine question whether it responds to studies of criminal policy as well as the true preventive and sanctioning incidence of this criminal type. The objective of this work is to analyze firstly, the criminal type of femicide, with emphasis on Ecuadorian regulation, and secondly, the incidence of the classification of this crime in the canton Machala, Ecuador, in the period 2019-2020, using analytical, synthetic, exegetical and comparative methods. It is concluded that the inclusion and application of this type of crime in the COIP has not resulted in a reduction in the commission of this crime, on the contrary, the levels have increased. | es_ES |
