Abstract
En el presente caso de estudio, hemos tratado un tema muy importante para la ciencia del derecho y para la academia, este es la legitima defensa y dentro de esta, la dificultad que existe para probar legítima defensa subjetiva dentro del proceso penal, que implica error de prohibición en algunos casos. El objetivo central de esta investigación ha sido el de determinar si en el proceso en que se condenó a Pedro Lucas Alcìvar por el delito de homicidio en grado de tentativa, existió un error del juzgador al condenar un caso en que existió un error de prohibición sobre los presupuestos de la legítima defensa.
Description
In this case study, we tried a very important for the science of law and academia issue,
this is self-defense and within this, the difficulty to prove self-defense opinion within the
criminal proceedings, which in some cases confused with the error of prohibition. The
main objective of this research was to determine whether the process in which he was
sentenced to Pedro Lucas Alcívar for the crime of murder is attempted, there was an
error of the judge when sentencing a case where there was an error ban on budgets of
self-defense. Pedro shot fatally wounding a person believing that it was threatening his
life imminently, when in fact it was the subject of a joke. In the case study, the criminal
proceedings advanced to the second instance, in the first was convicted prosecuted for
the crime of murder is attempted, and in the second instance acquitted him because the
room said of the facts shows a performance justified in self-defense.
