Planificación patrimonial preventiva como forma de evitar problemas post mortem en tiempos de pandemia.

Abstract

The SARS-COV2 pandemic that is hitting the world has shown that certain sectors of the Law, including civil law, can help to combat the problems derived from the departure of relatives due to this disease. The lack of culture in probate and planning matters raises legal and family problems since the death of a person transfers rights and obligations to their ascendants and descendants. For its part, preventive estate planning stands as a pillar in making early decisions, in order to avoid the problems before mentioned. The main objective of this work is to analyze the institution of preventive estate planning, in the context of the pandemic. To fulfill this objective, specialized bibliography in the area of civil law as well as financial issues was accessed, making use of exegetical and comparative methods, analyzing the main civil normative bodies of Ecuador. As a conclusion of the present research, preventive estate planning can serve in an early way as detection and eradication of certain inheritance problems.
