Abstract
El presente trabajo tiene la intención de presentar la situación de los adultos mayores -personas de 65 años-, quienes generalmente son abandonados por sus familiares, terminando sus últimos días solos, desprotegidos, sin atención médica ni alimentos, esto pese a que el Estado los reconoce como grupos de atención prioritaria, y que por su condición de vulnerabilidad no deberían a travesar estas circunstancias, por lo que tratare de determinar los preceptos constitucionales que amparan el derecho de alimentos de los adultos mayores? Y ¿Cuál es la institución jurídica más aplicable al caso concreto para garantizar alimentos a los ancianos? Por otro lado, se darán otras posibles soluciones al problema, como políticas de acción estatal?
Description
The present work intends to present the situation of the elderly - people of 65 years old, who are generally abandoned by their relatives, finishing their last days alone, unprotected, without medical attention or food, this despite the fact that the State Recognizes as priority attention groups, and because of their vulnerability they should not go through these circumstances, so I will try to determine the constitutional precepts that protect the right to food of the elderly? And what is the legal institution most applicable to the specific case to guarantee food to the elderly? On the other hand, will there be other possible solutions to the problem, such as state action policies?
