Abstract

The gradual increase in international sales that has occurred over time and that on some occasions there have been problems between the contracting parties (seller, buyer) raised the need to develop a legal instrument to help resolve these conflicts , from there the Vienna Convention on the International Sale of Goods (CVIM) signed in Vienna in 1980 has been applied. The creation of the Vienna Convention on the International Sale of Goods has been of vital importance for commercial merchandise transactions worldwide, as this governs international sales contracts, helping to reduce costs and, most importantly, the resolution of conflicts between seller and buyer. The main purpose of the CVIM is to provide a uniform legal instrument to the contracting parties, equitable in terms of obligations, rights; modern and that provides legal certainty to the parties so that they can carry out their commercial transactions in confidence. It should be noted that this Legal Framework only applies to international merchandise sales between companies, but not to merchandise sales for domestic consumption and for the provision of services, when this is the main part. The subject of the present investigation is the Application of the Regulatory Framework of the Vienna Convention regarding the International Sale of Goods, where the objective is to determine the legal consequences for breach of the obligations of the seller in the conclusion of the contract of international sale of goods, in accordance with the Vienna Convention.
