| dc.description | The present investigation exposes an exhaustive analysis of the conjunctures that occur in front of the separation of the parents and the restrictions that they impose in relation to the visiting right of the non-custodial father, in the same way it analyzes the situation of the minors and their right full enjoyment of their parents and develop a filial parental link, thus leading the judge to decide on deep problems of couples beyond the real facts reported, posing the following questions: what is the mechanism for determining the regime of visits ?, How does the justice operator act in situations of intrafamily violence? What is the right of minors in the face of the irreconcilable position of the parents? In this regard the Code of Children and Adolescents in its article 122 and following talks about this issue and protection measures in favor of the son or daughter because of physical, physical violence logical or sexual, in this sense the problem of Mr. Jorge Albornoz will be exposed in front of the refusal of the mother of her daughter to allow her to see the minor adducing domestic violence; thus giving a timely diagnosis to the problems raised in order to instruct and guide law professionals in situations of similar characteristics, highlighting the exercise of weighting performed by the authority as well as legal interests in conflict and the best interests of minors to give or deny the visitation regime. | es_ES |
| dc.description.abstract | La presente investigación expone un exhaustivo análisis de las coyunturas que se dan frente a la separación de los progenitores y las restricciones que estos imponen en relación al derecho de visitas del padre no custodio, de la misma manera analiza la situación de los menores y su derecho pleno de disfrutar de sus padres y desarrollar un vínculo parento filial, conllevando de esta forma al juez a decidir sobre problemas profundos de pareja más allá de los verdaderos hechos denunciados, planteando la siguientes interrogantes ¿cuál es el mecanismo para la determinación del régimen de visitas?, ¿cómo actúa el operador de justicia ante situaciones de violencia intrafamiliar?, ¿cuál es el derecho de los menores frente a la posición irreconciliable de los progenitores?, al respecto el Código de la Niñez y Adolescencia en su artículo 122 y siguientes nos habla acerca de este tema y las medidas de protección a favor del hijo o la hija por causa de violencia física, sicológica o sexual, en este sentido se expondrá la problemática del Sr. Jorge Albornoz frente a la negativa de la madre de su hija en permitirle ver a la menor aduciendo violencia intrafamiliar; dando así un oportuno diagnostico frente a la problemática planteada a fin de instruir y guiar a los profesionales del derecho ante situaciones de similar característica, destacando el ejercicio de ponderación realizado por la autoridad así como los bienes jurídicos en conflicto y el intereses superior de los menores para dar o negar el régimen de visitas. | es_ES |
