dc.descriptionCon el objetivo de caracterizar el proceso de aplicación del Derecho Laboral, en el contexto de la ciudad de Machala, se realizó una investigación de tipo descriptivo con enfoque cuanti-cualitativo, durante el primer semestre del año 2018. La estrategia metodológica fue sistematizada mediante métodos de investigación general: histórico-lógico, revisión documental, analítico-sintético y el estadístico. Para la recolección de la información se aplicó una encuesta a 100 trabajadores y 40 profesionales del Derecho. Los resultados obtenidos develan asimetría entre el discurso teórico y la aplicación del Derecho Laboral, evidenciada por la existencia de un marco legal normalizado por la Constitución de la República y el Código del Trabajo y por otra parte falencias en las relaciones laborales entre empleadores y trabajadores.es_ES
dc.description.abstractWith the objective of characterizing the Labor Law application process, in the context of the city of Machala, a descriptive research with quantitative-qualitative approach was carried out during the first semester of 2018. The methodological strategy was systematized by means of methods of general research: historical-logical, documentary review, analytical-synthetic and statistical. For the collection of information, a survey was applied to 100 workers and 40 legal professionals. The results obtained reveal asymmetry between the theoretical discourse and the application of Labor Law, evidenced by the existence of a legal framework standardized by the Constitution of the Republic and the Labor Code and, on the other hand, shortcomings in labor relations between employers and workerses_ES
