| dc.description | Reflexionar sobre la importancia de los métodos de interpretación y específicamente en el ámbito de las medidas cautelares, constituye un tema de constante debate académico e investigativo en las ciencias jurídicas a nivel internacional. Definir desde la teoría del constitucionalismo este aspecto, complejiza aún más los análisis que llegan desde los diversos paradigmas del derecho. Se pretende como objeto, acercarnos a ofrecer una valoración racional sobre la aplicabilidad doctrinal de los métodos de interpretación en las medidas cautelares a partir de un estudio aplicado en la ciudad de Machala en los años 2019 – 2020. En este orden se utilizaron métodos y técnicas que propiciaron sus conclusiones, entre estos el derecho comparado, exegético analítico, histórico lógico, inductivo deductivo, triangulación y el análisis de documentos. El aporte de la investigación recae, en la retroalimentación de las ciencias jurídicas a partir del análisis de la doctrina y praxis jurídica, conllevando a respaldar el paradigma de la debida utilización de los métodos de interpretación en las medidas cautelares. | es_ES |
| dc.description.abstract | Reflecting on the importance of interpretation methods and specifically in the field of precautionary measures, constitutes a subject of constant academic and investigative debate in legal sciences at the international level. Defining this aspect from the theory of constitutionalism further complicates the analyzes that come from the various paradigms of law. It is intended as an object, to come closer to offering a rational assessment on the doctrinal applicability of the methods of interpretation in the precautionary measures based on a study applied in the city of Machala in the years 2019-2020. that led to its conclusions, among them comparative law, analytical exegetical, logical historical, deductive inductive, triangulation and document analysis. The contribution of the research falls on the feedback of the legal sciences from the analysis of the doctrine and legal practice, leading to support the paradigm of the proper use of interpretation methods in precautionary measures. | es_ES |
