| dc.description | El estado de excepción es una figura jurídica excepcional, que el jefe de Estado decreta frente a situaciones cuya solución escapan a la actuación ordinaria, como la pandemia por el COVID–19; en este contexto el presidente constitucional del Ecuador en uso de sus atribuciones, promulgó el 16 de marzo del 2020, el Decreto No. 1017 de Estado de Excepción y posterior solicitud de prórroga. El presente artículo tiene como objetivo analizar la vigencia de los derechos constitucionales en el Estado de Excepción con motivo de la emergencia sanitaria del COVID-19. Entre los resultados que arrojó la investigación, tenemos que el control constitucional, es un elemento que garantiza equilibrio en la separación de poderes en un Estado constitucional como el Ecuador. | es_ES |
| dc.description.abstract | The state of exception is a legal figure that the Head of State decrees in the face of situations whose solution is beyond ordinary action, such as the COVID-19 pandemic, for which reason the constitutional President of Ecuador, in use of his powers, promulgated on the 16th March 2020 Decree No. 1017 of the State of Exception and subsequent request for an extension. Its objective is to analyze the validity of constitutional rights in the State of Exception due to the health emergency of COVID-19. The results showed that the investigation, the constitutional control is an element that guarantees balance in the separation of powers in the State of rights. | es_ES |
