La motivación de las sentencias constitucionales como garantía del derecho al debido proceso.

Abstract

Motivation as a constitutive element of due process and legal security becomes a fundamental right expressly recognized in the constitutional text. In Ecuador, the jurisdictional function is essential for an adequate legal process, to settle conflicts and decide controversies, considered one of the primary purposes of the State, it is the instrument to ensure the right in turn, it constitutes the means to access the protected values by the State, the jurisdiction. However, in Ecuador there is a clear moral breakdown without limits, which has caused justice in Ecuador to be questioned both due to the absence of values and principles and the poor professional training of the judges. In this sense, the objective of the investigation is to avoid the erroneous issuance of sentences that lack justification, in order to ensure that justice is timely and effective, respecting the basic guarantees of due process.
