| Descripción : | The present paper is an analysis of legal study focused specifically on the needs that artisanal fishermen suffer from lack of information on safety measures and on the benefits that the law gives, for this cause I try that through a compulsory insurance for the benefit of the fishermen, pretending to smear the benefits of peasant social security for the legal protection with respect to the workers who use artisanal fishing as their source of income , and elicits while are provided for in the law of both the Labor Code ( against accidents at work) as well as within the Social Security Act, referring to the (general insurance for accidents at work) as envisaged The art 155 of the Social Security Act and although employers or insurance companies can demonstrate that it is a violation of the freedom of contract law that is enshrined in the constitution of the republic, but it is no less true that compared to the incidents this sector is checked out. In our country there are many weaknesses that are daily in the artisanal fishing boats in the area of maritime safety, because it does not comply with the requirements due that demand the entities responsible for providing the necessary assurances in the sea, therefore it is important to give to know the aspects of greatest importance and in this way to apply them to each vessel can provide the appropriate security measures.There is a high degree of lack of knowledge in the field of maritime security by shipowners and other staff that creates this type of fishing vessels, the responsibility for the safety at sea should be in charge of administrators and the fishermen, in the same way the effort and assistance must be shared between the two groups in order to ensure effective collaboration that allow the fishery is a craft more insurance. For such reason, I decided to undertake this work in order to propose that it be appended, and give rights of protection through a compulsory insurance for artisanal fishermen focused as a priority the occupational accidents, but also aims to deliver information and recommendations in order to contribute To avoid some of the more frequent and severe risks of this sector; for shows and this is the engine that drives this research i to know the case of Mr. Tomas CRUZ ITURRALDE with case number 07371- 2016-00123; it is in this process due to a lack of safety measures and protection was raised an accident at work in the "Don Tomas " lost his left lower extremity.In these facts are conducted a compensation according to what the Labor Code envisages, however the VII disinformation of the other rights or benefits that the Social Security Act gives you directly has made that cannot make use of the same as well as the Social Security Act ignored in the face of these events, which have not been incorporated in its legislation a special regime in Ecuadorian legislation. | Resumen : | El presente análisis está enfocado específicamente en las necesidades que los pescadores artesanales sufren por falta de información sobre las medidas de seguridad, y sobre los beneficios que la ley les otorga, por esta causa procuro que mediante un seguro obligatorio a beneficio de los pescadores artesanales, pretendiendo impregnar los beneficios del seguro social campesino para la protección jurídica respecto a los trabajadores que utilizan la pesca artesanal como su fuente licita de ingreso , y si bien se encuentra prevista en la ley de tanto del Código Laboral como también dentro de la Ley De Seguridad Social, según lo contempla el art 155 de la Ley De Seguridad Social y aunque de seguro los patronos o empresas pueden manifestar que es una violación a la libertad de contratación pero, no es menos cierto que frente a los incidentes este sector se encuentra desprotegido. Por tal motivo, decidí realizar este trabajo a fin de proponer que se anexen, y se otorgue derechos de protección mediante un SEGURO OBLIGATORIO PARA PESCADORES ARTESANALES enfocado como prioridad los accidentes laborales; para muestra y siendo este el motor que impulsa esta investigación doy a conocer el caso del Sr. TOMAS CRUZ ITURRALDE con numero de caso 07371-2016-00123; ya que en este proceso por falta de medidas de seguridad y protección se suscitó un accidente laboral en el que perdió su extremidad inferior izquierda. En estos hechos se realizó una indemnización según contempla el Código De Trabajo, sin embargo la desinformación de los derechos y beneficios que La Ley De Seguridad Social le otorga ha hecho que no pueda hacer uso de los mismos, como también esta ley hace caso omiso frente a estos sucesos, por no haberse incorporado en su normativa un régimen especial en la legislación ecuatoriana. |
