Efectos de los estados de excepción a consecuencia de la emergencia sanitaria por la pandemia derivada de la COVID-19

Abstract

The Constitution of the Republic of Ecuador establishes mechanisms to act in ordinary situations, as well as mechanisms to deal with internal insurrections or external threats. Through this article we will highlight the effects that the states of exception dictate as a consequence of the health emergency due to the pandemic derived from COVID-19 in Ecuador, during the years 2020 and 2021, being a total of six 6 Executive Decrees decreeing states of exception and three 3 renewals of said states of exception. For which a documentary analysis will be carried out in the framework that is the result of the compilation and analysis of the information collected from magazines, internet pages, and legal bodies referring to the legal institution of the states of exception. The inductive - deductive method and the exegetical method were applied for the interpretation of the different laws, international instruments, principles, analysis of the executive decrees issued as a result of the health emergency due to the COVID-19 pandemic and review of the opinions of the Constitutional Court for the purposes of constitutional control of state of emergency decrees, in order to know the nature and scope of the state of emergency and to be able to establish the respective conclusions.
