Eficacia de la justicia restaurativa en materia de niñez y adolescencia en el Ecuador

Abstract

This research work will address restorative justice essentially in the field of children and adolescents in Ecuador, starting from the fact that the adolescent offender is responsible for his negative actions but does not enjoy all his rights independently, it is here where a range of measures for these situations is expanded, given that a new code for children and adolescents has been implemented, and there is a double violation for this group. Also, it is not excluded that the competent authorities enter to solve this conflict, however, Ecuador does not have a favorable number of judges. Likewise, this research will develop its legal historical evolution, the effectiveness of restorative justice, the institutions that are in charge of the offenses of adolescents, in addition to what it implies to take appropriate measures for an effective reintegration into society, to obtain a comparative view with our neighboring country Peru and to show the current situation that the Ecuadorian adolescent community lives. The main factor of this research is to find that stable dynamic between the offender inmate and the reintegration into society, to find that harmonic balance of a safe and reliable community is what every country seeks to have. Ecuador is no exception, after the current situation worldwide, the pandemic was a breaking point, so the implementation of an effective system to strengthen adolescent justice and develop programs, new working tools, and specialized teams for judicial units is the goal that the country seeks to achieve nationally.
