Acceso y justiciabilidad del derecho a la salud para las personas con enfermedades catastróficas o degenerativas

Abstract

The present research work aims to make a legal analysis of access and justiciability of the right to health for people with degenerative diseases, the case of Laron syndrome and others like it. In order to start this topic, it is necessary to review concepts, set the theoretical framework, on access and justiciability of the right to health, which will be achieved through an exhaustive investigation of its doctrines, national constitutional jurisprudence, international treaties and it´s relevant standards. These will allow us, first of all, verify and explain what constitutional rights are involved, the right to health for people with degenerative diseases laron Syndrome and others like it, determining whether there is a violation of these rights by the Constitutional Court. We will focus our attention on the different jurisprudential lines issued by the Constitutional Court in relation to the subject in question. This will allow us to reach the main objective of our research, highlighting the problem around the justiciability of the right to health in relation to the Laron syndrome and others like it, to be able to propose mechanisms to achieve full protection of these constitutional rights.
