| Descripción : | El trabajo sustenta que el Art. 94 de la Ley de Seguridad Social, es inconstitucional y atentatorio a los derechos humanos, ya que el afiliado y sus deudos deberían recibir sus prestaciones económicas independientemente de que su patrono no haya pagado sus aportes al Instituto Ecuatoriano de Seguridad Social; sin tener que recurrir a acciones de protección en contra del Estado, por vulneración al derecho a la seguridad social, como sucede en muchos de los casos y que han sido materia de estudio. El objetivo del presente artículo es determinar a través del análisis jurídico, la inconstitucionalidad del referido artículo, en la vulneración a la concesión del derecho de montepío para los beneficiarios de los afiliados al IESS. |
| Resumen : | He work sustains that Art. 94 of the Social Security Law is unconstitutional and violates human rights, since the member and their relatives should receive their financial benefits regardless of whether their employer has not paid their contributions to the Ecuadorian Institute of Social Security; without having to resort to protective actions against the State, for violation of the right to social security, as happens in many of the cases that have been the subject of study. The objective of this article is to determine, through legal analysis, the unconstitutionality of the aforementioned article, in the violation of the concession of the right of montepío for the beneficiaries of the members of the IESS.
