Acción de protección impugnando un acto administrativo, por parte del representante legal de Chone afecta el derecho de propiedad

Abstract

The present develops has as its general objective the study of the Protection Action as a basic jurisdictional guarantee when there is a violation of constitutional rights, whether through acts or omissions of judicial, non-judicial officials, organs, agencies of the State or of the private sector that provide any type of public or private services, of public employees in the performance of their positions that undermine constitutional rights or deprive the person of full enjoyment of them, which also analyzes the scope of the responsibility of the State regarding the effective judicial protection and legal security of constitutional rights that is expressed in the Constitution of the Republic of Ecuador, before the Property Law that is violated by means of an administrative act that denies its full exercise issued the Autonomous Decentralized Municipal Government of the canton Chone. The methodology to be used in this work will be Documentary Research, which will be carried out with the implementation of qualitative research techniques that will be collecting scientific and suitable information, from which the importance of full enjoyment and freedom to exercise constitutional rights and legal rights is exposed. Jurisdictional mechanisms to guarantee its protection, emphasizing the Protection Action, as an immediate, direct and effective jurisdictional mechanism of immediate application that safeguards it. These research elements will allow to conclude the proposed practical case, in which the violation of the constitutional right of property is evidenced.
