Abstract

The present investigation was carried out with the objective of determining if the National Customs Service of Ecuador as the competent authority, has the power to donate weapons and ammunition that are abandoned in the wineries of the institution, to a non-profit association , through the free award. This fact was analyzed, and when it was discovered that it is not possible to deliver this type of benefit to this type of institution, we proceeded to describe through the revision of the Organic Code of Commerce and Investment Production and its Regulations, to which company if You could award this type of merchandise for free. Concluding that it is the Ministry of National Defense, the body to which this benefit can be attributed, and also breaking down the type of procedure that must be followed as a public institution to request it. As for the method used, the analysis-synthesis method was used, which consists of separating each of the elements of the subject to study them separately and then joining them through synthesis. And as materials, scientific articles from indexed journals, reliable web page information and a single book in particular were used.
