Abstract

International trade has allowed the economic growth of nations and economic groups thanks to the transfer of goods and services across geographic borders, becoming important in recent years for its dynamism, which has caused certain controversies between importer and exporter, in addition to variations in its regulation from its different levels of application (international. Regional and local). For this there are the Incoterms and the Vienna Convention of 1980, which allow to determine the responsibilities of buying and selling merchandise under the Incoterms that has been fixed within the contract in which it defines the responsibilities, obligations and rights of the parties. The present work seeks to determine the responsibilities between buyer and seller of the CCVIM under the Incoterm DDP in addition to assessing the applicability of the same, analyze each of the responsibilities and finally determine the consequences in case of breaches. To achieve the stated objectives, theoretical, historical - logical, synthetic analytical, deductive inductive methods were used based on literary reviews and research and search instruments. The case in question is about a contract executed by Germany and France in the sale of office clothes where the seller meets the delivery date established in the contract and the buyer is not responsible for them in addition to the payment of the price That was agreed. It was concluded that the buyer breached his responsibilities by letting the seller make use of his rights that are stipulated within the CCVIM.
