Abstract
The present theoretical study was developed in the application of comparative law, which analyzes labor stability and dismissal from the perspective of the State as a guarantee of the right to work, as well as other fundamental rights that are based on the work stability of people. In this sense, this work developed topics related to the right to work, its historical development, unjustified dismissal, among others.

El presente estudio teórico se desarrolló en la aplicación del derecho comparado, en el que se analiza a la estabilidad laboral y al despido desde la visión del Estado como garantista del derecho al trabajo, así como de otros derechos fundamentales que se sustentan en el y la estabilidad laboral de las personas. En este sentido, el presente trabajo desarrolló temáticas relacionadas al derecho al trabajo, su desarrollo histórico, el despido injustificado, entre otros.
