| Descripción : | The mediation as an alternative resolution of family conflicts in the shared custody of children, it is viable to the extent that this is a voluntary process that seeks to resolve conflicts in the family, sparing no economic resources of those who look for alternatives and fair agreements through a neutral third party accredited. However, the shared custody is not covered in the Code on Children and Adolescents despite the fact that the Constitution of the Republic of Ecuador establishes co-responsibility of the parents in the upbringing and education of their children in particular when they are separated from them for any reason, this lack of legal basis is added the little predisposition and little knowledge on the part of parents to cope with this type of situations generating unrest and instability in the whole group, but with greater intensity in children. It is therefore essential to identify the stages to be followed in the mediation of family disputes, in the shared custody of children. The present work has a systemic approach and a qualitative methodology and literature review. Proposing the shared custody of children product of this alternative process where the parties involved understand that the father must not be seen only as the economic provider and the mother and caregiver, but that there is a full co-responsibility in the upbringing and education of children where the stability and well-being of the same through the active participation of both parents. |
| Resumen : | La mediación como alternativa de resolución de los conflictos familiares en la custodia compartida de niñas y niños, es viable en la medida que este es un proceso voluntario que busca resolver conflictos en el ámbito familiar, escatimando recursos económicos de quienes buscan alternativas y acuerdos justos a través de un tercero neutral acreditado. Sin embargo la custodia compartida no está amparada en el Código de la Niñez y la Adolescencia pese que la Constitución de la República del Ecuador establece corresponsabilidad de los padres en crianza y educación de sus hijos en particular cuando se encuentren separados de ellos por cualquier motivo, a esta falta de base legal se le suma la poca predisposición y escasos conocimientos por parte de los progenitores para sobrellevar este tipo de situaciones generando malestar e inestabilidad en todo el grupo, pero con mayor intensidad en los niños. Por ello es fundamental Identificar las fases a seguir en la mediación de conflictos familiares en la custodia compartida de niñas y niños. El presente trabajo tiene un enfoque Sistémico y una metodología de corte cualitativo y de revisión bibliográfica. Proponiendo la custodia compartida de niños, niñas producto de este proceso alternativo donde las partes inmersas entiendan que el padre no debe ser visto solo como el proveedor económico y la madre como cuidadora, sino que exista una plena corresponsabilidad en la crianza y educación de los hijos donde prime la estabilidad y bienestar de los mismos a través de una participación activa de ambos progenitores. |
