| Descripción : | In Ecuador, labor rights are inalienable and intangible. This research work is aimed at resolving the conflicts and questions that the legitimate heirs have when confronting the bureaucratic system to demand the labor rights that are due to it by law. It also makes a tour of the actions of public and private institutions and how it influences the success of the heirs, reliable information and the timely help they can provide for the simplification in the procedures, without this means, transgressions or Legal disrespect. With the Action of the Habeas Data we will study how and for what reasons the holder of the right can request before the authority or person responsible for the registration of the data the personal information that it requires, whether they are in public or private institutions; Giving it the right to demand that data be rectified, deleted or canceled when they violate the right to privacy and reliable information guaranteed in constitutional principles and norms. |
| Resumen : | En Ecuador los derechos laborales son irrenunciables e intangibles. El presente trabajo de investigación está dirigido a resolver los conflictos y las interrogativas que tienen los legítimos herederos al hacer frente al sistema burocrático para exigir los derechos laborales que por ley le corresponden. Así también realiza un recorrido por el accionar de las instituciones públicas y privadas y cómo influye en el éxito de los herederos, la información fidedigna y el auxilio oportuno que las mismas pueden brindar para la simplificación en los trámites, sin que esto signifique, transgresiones o desacatos legales. Con la Acción del Hábeas Data estudiaremos cómo y por qué motivos el titular del derecho puede solicitar ante la autoridad o persona responsable del registro de los datos la información personal que requiera, sea que se encuentren en instituciones públicas o privadas; otorgándosele el derecho de exigir que se rectifiquen, eliminen o anulen los datos cuando vulneran el derecho a la intimidad y a la información fidedigna garantizados en los principios y normas constitucionales. |
