The intensity reached by human trafficking and illegal smuggling has made it a matter of global
interest. This analytical and qualitative research interprets how the current regulations in
Ecuador on human mobility serves the purpose of protecting the rights of migrants and prevents
the production of phenomena such as illegal trafficking, concluding that there is a gap in public

La intensidad alcanzada por la trata y el tráfico ilegal de personas, la ha convertido en asunto
de interés global. Esta investigación analítica y cualitativa, interpreta cómo la normativa
vigente en Ecuador sobre movilidad humana sirve a la finalidad de proteger los derechos de
los migrantes y evita la producción de fenómenos como el tráfico ilegal, concluyendo que
existe un vacío en la política pública y las acciones gubernamentales en materia de migración
que no permiten esa finalidad.
