Descripción : El presente trabajo de titulación de carácter complexivo es realizado del compendio de reactivos parte practica en la que trata del conflicto entre arrendatario y arrendador en materia civil inquilinato, que se ejecutara en el procedimiento sumario, en el cual, se busca demostrar la vulneración de los derechos del arrendatario, la falta de la normativa en la Ley de inquilinato, los tipos de Contrato, analizaremos que dice la Constitución política del Ecuador, el Código Orgánico de Procesos y la Ley de inquilinato. En el análisis del caso practico será conocido por un juez de lo civil si no hubiere juez de inquilinato, el caso no menciona el contrato de arrendamiento, de la fecha de terminación del contrato de arrendamiento, si fue verbal o escrito, de igual manera o forma se ve a simple vista la vulneración de los derechos del arrendatario. Primeramente recordaremos un poco de la historia del arrendamiento, conceptos y definiciones del tema a tratar, parte dogmática, teórica, y legal del arrendamiento. Que hacer cuando te encuentras con un arrendador abusivo? Lo que por falta de conocimiento de la ley lesiona los derechos del arrendatario, estos términos trataremos de explicar en el trabajo investigativo. Los métodos de investigación utilizados en este proceso son el método cualitativo, el método general, y un procedimiento reflexivo, sistemático y critico. Tiene como objetivo resolver el problema legal del arrendatario, y llegar a una resolución y explicación favorable, previa la obtención del titulo de Abogados de los Tribunales de la Republica del Ecuador.
Resumen : The present title work of complex character is made of the compendium of reagents practical part in which deals with the conflict between tenant and landlord in civil matters tenancy, which will be executed in the summary procedure, in which, we seek to demonstrate the violation of the rights of the tenant, the lack of regulations in the Law of tenancy, the types of contract, we will analyze what the Constitution of Ecuador, the Organic Code of Processes and the Law of tenancy says. In the analysis of the practical case will be known by a civil judge if there is no judge of tenancy, the case does not mention the lease, the date of termination of the lease, if it was verbal or written, in the same way or form is seen at a glance the violation of the rights of the tenant. First we will remember a little of the history of the lease, concepts and definitions of the subject to be discussed, dogmatic, theoretical, and legal part of the lease. What to do when you encounter an abusive landlord? What to do when you encounter an abusive landlord, who for lack of knowledge of the law injures the rights of the tenant, these terms we will try to explain in the research work. The research methods used in this process are the qualitative method, the general method, and a reflective, systematic and critical procedure, with the objective of solving the legal problem of the tenant, and to reach a solution and a favorable explanation, in order to obtain the title of Lawyers of the Courts of the Republic of Ecuador.
