Descripción : Por medio del comercio internacional se produce el intercambio de mercancías entre los diversos países, siendo una actividad promotora del desarrollo de las naciones, por ende, esta debe ser regulada a través de la Aduana, la cual tiene por tiene por misión facilitar y controlar el ingreso y salida de bienes, mediante la aplicación de distintos regímenes aduaneros. En el país, el Servicio Nacional de Aduana del Ecuador (SENAE) es la encargada de gestionar los trámites para que las empresas puedan acogerse a los distintos regímenes que el Código Orgánico de la Producción, Comercio e Inversiones y su reglamento establecen. En la presente investigación, se aborda el régimen de Admisión temporal para reexportación en el mismo Estado, el cual admite el ingreso se determinados bienes, por un tiempo específico, sin que sufran modificaciones, y una vez culminado este periodo deben ser reexportados al país de origen. El problema de investigación, se enmarca en: ¿Cuál es el procedimiento a seguir en las importaciones de maquinarias que se acogerán al régimen de Admisión Temporal para Reexportación en el mismo Estado? se establece como objetivo: Desarrollar el procedimiento que se debe seguir en las importaciones que están bajo el régimen de Admisión Temporal para Reexportación en el mismo Estado. Los resultados de la investigación están orientados a desarrollar una guía que permita el correcto cumplimiento del proceso de importación bajo el régimen de Admisión Temporal para Reexportación en el mismo Estado, además de determinar los tributos según indica el COPCI.
Resumen : Through international trade, there is an exchange of goods between the various countries, being a promoter of the development of nations, therefore, it must be regulated through Customs, which is intended to facilitate and control the entry and exit of goods, through the application of different customs regimes. In the country, the National Customs Service of Ecuador (SENAE) is in charge of managing the procedures so that companies can benefit from the different regimes established by the Organic Code of Production, Commerce and Investments and its regulations.In the present investigation, the temporary Admission regime for re-export in the same State is addressed, which admits the entry of certain goods, for a specific time, without suffering modifications, and once this period has ended they must be re-exported to the country of origin. The research problem is framed in: What is the procedure to follow in imports of machinery that will be eligible for the Temporary Admission for Re-export regime in the same State? The objective is to: Develop the procedure to be followed in imports that are under the Temporary Admission for Re-export regime in the same State.The results of the investigation are aimed at developing a guide that allows the correct fulfillment of the import process under the Temporary Admission for Re-export regime in the same State, in addition to determining the taxes as indicated by the COPCI.
