Descripción : En Ecuador, el Servicio de Rentas Internas es el ente recaudador de la Administración Tributaria teniendo como base principal los principios de justicia y equidad, de esa forma encaminarse a crear una cultura tributaria y evitar que exista la evasión y elusión de tributos. Resumiendo, el Estado en todo momento se encuentra en la gran necesidad de recaudar impuestos para alcanzar en forma creciente los objetivos planteados pero lamentablemente la falta de cultura tributaria hace que los contribuyentes se encuentren reacios a disponer de sus rentas, debiendo el Estado buscar algún sistema de tributación que permita mantener un criterio equilibrado para ambas partes y que permita recaudar los recursos necesarios para solventar los gastos que generan las diferentes carteras de Estado Torrico (2015). El sector camaronero, al ser un sector que aporta con su producción, para que el Estado pueda obtener ingresos al PIB por las exportaciones realizadas se ha convertido en unos de los sectores más neurálgicos del País, por cuanto no existe un ente que controle precios de insumos, materia prima y precios para poder negociar con las empacadoras encargadas de la exportación; esta situación provoca que exista mucha variación en las producciones de un ciclo a otro. El Impuesto a la Renta estableció el Estado, con la finalidad de poder captar recursos de parte de las empresas sean jurídicas o naturales que se encuentren establecidas en el territorio nacional y que se encuentren ejerciendo algún tipo de actividad sea productiva o de servicios con fines de lucro. Las empresas o personas sean naturales o jurídicas se han visto en cierta manera afectados en su economía por el Impuesto a la Renta, ya que dentro de este impuesto se contempla un rubro denominado Anticipo del Impuesto a la Renta mismo que al finalizar el período fiscal de una empresa, si esta genera pérdidas este Anticipo no pasa a transformarse como crédito tributario para el contribuyente, el Servicio de Rentas Internas toma a este Anticipo como un aporte no reembolsable por parte de las empresas. El sujeto pasivo al tener plena conciencia de lo manifestado en el párrafo anterior se ha visto en la necesidad de buscar alternativas para disminuir el valor a pagar por Impuesto a la Renta, a pesar de tener pleno conocimiento de los altos riesgos de manipular de una u otra forma las diversas cuentas que influyen directamente en la Liquidación del Impuesto a la Renta; otro problema que se aprecia es el continuo cambio de la Ley y Reglamento tributario, mismos que son difundidos únicamente a través de la plataforma del Servicio de Rentas Internas, y los profesionales encargados del área contable financiera en su mayoría no tiene el acceso o tiempo para estar realizando estas modificaciones importantes, lo cual redunda en un mal planteamiento y cálculo en la Liquidación del Impuesto a la Renta, en otras palabras no existe la capacitación continua sobre este tema. El objetivo principal de este trabajo investigativo es determinar los rubros sobre los que se aplicó correctamente la liquidación del Impuesto a la Renta, mediante el análisis de los resultados financieros, para verificar si existe una liquidación adecuada. Para esto se aplicó la metodología de manera bibliográfica, no experimental inductivo, descriptivo y analítico-sintético; en donde se realizó la respectiva visita a la empresa para poder constatar las diferencias que existe en la liquidación del impuesto a la renta con un análisis horizontal y de esa manera poder verificar los rubros más afectados. En cuanto a los resultados obtenidos en la liquidación del impuesto a la renta se ha logrado conocer que en la empresa no están aplicando correctamente las normas tributarias vigentes.
Resumen : In short, the Internal Revenue Service is the collection entity of the Tax Administration based on the principles of justice and fairness, thus aiming to create a tax culture and prevent tax evasion and avoidance, and thus achieve increasingly the objectives set by the State to raise the necessary resources that generate income for the welfare of Ecuadorians. The shrimp sector, being a sector that contributes with its production so that the State can obtain income from GDP due to the exports made, has become one of the most neuralgic sectors of the country, since there is no entity that controls input prices, raw material and prices to negotiate with the balers in charge of export; this situation causes that there is a lot of variation in the productions from one cycle to another, not being able to find a standard that allows comparing two consecutive periods so that the experts of the Internal Revenue Service reach in some cases conclusions and statements that have nothing to do with reality. The Income Tax established the State with the purpose of being able to capture resources from companies, whether legal or natural, that are established in the national territory and that are exercising some type of activity, be productive or for profit services. Companies or individuals, whether natural or legal, have been affected in their economy in some way by the Income Tax, since this tax includes an item called Income Tax Advance same as at the end of the fiscal period of a company, if this generates losses this Advance does not become a tax credit for the taxpayer, the Internal Revenue Service takes this Advance as a non-refundable contribution by the companies The taxpayer, having full awareness of what was stated in the previous paragraph, has found it necessary to seek alternatives to reduce the value to be paid for Income Tax, despite having full knowledge of the high risks of handling a otherwise, the various accounts that directly influence the Liquidation of Income Tax; Another problem that can be seen is the continuous change of the Tax Law and Regulations, which are disseminated only through the Internal Revenue Service platform, and the professionals in charge of the financial accounting area mostly do not have access or time to be making these important changes which results in a bad approach and calculation in the Liquidation of Income Tax, in other words there is no continuous training on this subject The main objective of this research work is to determine the items on which the income tax settlement was applied correctly, by analyzing the financial results, to verify if there is a correct settlement. For this, the methodology was performed in a bibliographic, non-experimental inductive, descriptive and analytical-synthetic manner; where the respective visit to the company was made to be able to verify the differences that exist in the liquidation of the income tax with a horizontal analysis and in this way to be able to verify the most affected items. Regarding the results obtained in the liquidation of the income tax, it has been known that the current tax regulations are not being correctly applied in the company..
