Descripción : In Ecuador our legal system has legislation to regulate situations occurring in the sea or aquatic spaces, for example we have the Maritime Police Code in the case of contraventions or situations of lesser legal magnitude, and there is also the Integrated Organic Code for the case Commissions of crimes, as the law in the maritime field tries to order the multiple activities that occur at sea, such as collisions or collisions, which is what the present work is about. First of all we must know that in countries like ours that have coast or riverbank, there is great maritime and port activity, among them artisanal, commercial fishing, transport and maritime commerce, among others. Before all maritime traffic, all these activities are very common that there are risks, risks that must be understood as any fortuitous event, force majeure, accident or fact with repercussions on the crew, passengers, boat or cargo. One of the main ones is the approach, which in the maritime sense is considered to be the collision of two or more boats or ships, for predictable or unforeseeable causes caused by actions or omissions of human behavior or by events that escape their will or Their correct course; In the absence of a legal concept, we must understand this as the violent and direct clash of ships with a harmful result. The present work will try to discuss how our legislation has typified these situations, considering International Law and the other current rules that govern us.
Resumen : En el Ecuador nuestro ordenamiento jurídico posee legislación para regular situaciones acaecidas en el mar o espacios acuáticos, por ejemplo tenemos el Código de Policía Marítima en el caso de contravenciones o situaciones de menor magnitud legal, y también está el Código Orgánico Integral Penal para el caso cometimientos de delitos, pues el derecho en el campo marítimo trata de ordenar las múltiples actividades que se presentan en el mar, como los abordajes o colisiones, que es lo que se trata el presente trabajo. Primeramente debemos conocer que en países como el nuestro que poseen costa o ribera, existe gran actividad marítima y portuaria, entre ellas la pesca artesanal, comercial, transporte y comercio marítimo, entre otros. Ante tanto tráfico marítimo, todas estas actividades son muy común que existan riesgos, riesgos que deben entenderse como todo caso fortuito, fuerza mayor, accidente o hecho con repercusiones en los tripulantes, pasajeros, embarcación o carga. Uno de los principales es el abordaje, que en sentido marítimo se considera a la colisión de dos o más embarcaciones o navíos, por causas previsibles o imprevisibles provocadas por acciones u omisiones de la conducta humana o por hechos que se escapan de su voluntad o de su correcto proceder; ante la ausencia de un concepto legal, debemos entender a este como, el choque violento y directo de naves con un resultado dañoso. El presente trabajo intentara debelar como nuestra legislación ha tipificado estas situaciones, considerando el Derecho Internacional y las demás normas vigentes que nos rigen.
