Descripción : The objective of our research work as the main point is to demonstrate if the judge of the judicial unit of the woman of the family of the child and adolescent offenders did well or not to give the right to parental authority to his biological father. In this analysis, in which I have as main objective, the focus on parental authority, once in the Ecuadorian civil legislation in his article. Parental authority is the set of rights that parents have over their non-emancipated children. Children of any age, not emancipated, are called children of family; And the parents, relative to them, parents. The present analysis is based on the observation of emotional and behavioral changes in minors, as a consequence of the separation of their figures from attachment by the effect of restraining orders or custodial sentences during a period of weather. In this sense, people are affected in some way, and it is derived in judicial conflicts, even though the law is clear regarding this fact, but it is not taken into account to who is subjected the members of this family nucleus in particular. Minors Regarding the methodology, we have turned to hermeneutics, to the proper interpretation of normative legal and constitutional texts.
Resumen : El objetivo de nuestro trabajo investigativo como principal punto es demostrar si el señor juez de la unidad judicial de la familia mujer niñez y adolescentes infractores hizo bien o no en darle el derecho la patria potestad a su padre biológico. En este análisis, en el cual tengo como objetivo principal, el enfoque respecto a la patria potestad, a su vez en la legislación civil ecuatoriana en su artículo. La patria potestad es el conjunto de derechos que tienen los padres sobre sus hijos no emancipados. Los hijos de cualquier edad, no emancipados, se llaman hijos de familia; y los padres, con relación a ellos, padres de familia. El presente análisis encuentra su origen en la observación de los cambios emocionales y conductuales en menores de edad, como consecuencia de la separación de sus figuras de apego debido al efecto de órdenes de alejamiento o sentencias privativas de la patria potestad durante un periodo de tiempo. En este sentido las personas se ven afectados de alguna manera, y esto deriva en conflictos judiciales, aun cuando la ley es clara respecto a este hecho, pero no se toma mucho en cuenta a quien es sometido los integrantes de este ex núcleo familiar en especial los menores de edad. Respecto a la metodología, hemos acudido a la hermenéutica, por ello con la interpretación idónea de los textos normativos legales y constitucionales.
