Descripción : Our main objective is to demonstrate how the rights of indigenous property are violated and above all how the constitutional rights established in art.57 of indigenous peoples are affected; The provisions of ILO Convention No. 169, "Convention on Indigenous and Tribal Peoples, 1989"; And the concordance of the real analysis, content of the interpretation to the art. 21 of the American Convention on Human Rights, in relation to the private property of members of indigenous communities. As for the theoretical framework, our work is based on bibliographical consultations in specialized texts, as well as indexed journals of scientific research, technical-professional and scientific and cultural dissemination; Which enriches its scientific content, with a high standard of quality. In this case we will analyze the action of the Ecuadorian state that intends by administrative resolution of the interior ministry to expropriate the ancestral agricultural lands of the indigenous, to use as a field of maneuvers of the Ecuadorian army; And in which it will be demonstrated that it violates the rights recognized in the constitution of the republic of the equator that typifies in its article 57, numerals 4, 11 and 20; For this, a protection action is proposed. In conclusion, it will be possible to determine whether the claim through the application of the constitutional guarantees invoked by the ancestral communities prevails in the application of justice or influences the decision of the state through its coercive organs.
Resumen : Nuestro objetivo principal es demostrar cómo se vulneran los derechos de las propiedades indígenas y sobre todo como se afectan los derechos constitucionales tipificados en el art.57 de los pueblos indígenas; las disposiciones del convenio número 169 de la OIT, “convenio sobre pueblos indígenas y tribales, 1989”; y la concordancia del análisis real, contenido de la interpretación al art. 21 de la convención americana sobre derechos humanos, en relación con la propiedad privada de los miembros de las comunidades indígenas. En cuanto al marco referencial teórico, nuestro trabajo se sustenta sobre la base de consultas bibliográficas en textos especializados, así como también en revistas indexadas de investigación científica, técnico-profesionales y de divulgación científica y cultural; lo que enriquece su contenido científico, con un elevado estándar de calidad. En este caso se analizará la actuación del estado ecuatoriano que pretende mediante resolución administrativa del ministerio del interior expropiar las tierras ancestrales agrícolas de los indígenas, para usarlas como campo de maniobras del ejército ecuatoriano; y en la que se demostrará que viola los derechos reconocidos en la constitución de la república del ecuador que tipifica en su artículo 57, numerales 4, 11 y 20; Para ello se plantea una acción de protección. En conclusión se podrá determinar, si el reclamo mediante la aplicación de las garantías constitucionales, que invocan las comunidades ancestrales, prevalece en aplicación de la justicia, o influye la decisión del estado, mediante sus órganos coercitivos.
